Singapore Water Association will be organising a 2-day course, Introduction to Formal Dispute Resolution in Singapore (SOPA, Arbitration and Litigation) on 26 & 27 August 2024. This course is to equip participants with a working knowledge of the most commonly encountered types of formal dispute resolution proceedings in Singapore, including their differences

SYNOPSIS
In terms of formal dispute resolution proceedings, the three most commonly encountered types for the construction industry in Singapore are adjudication under the Building and Construction Industry Security of Payment Act 2004 (“SOPA”), arbitration, and litigation.
Learning Outcomes
• Working knowledge of how SOPA operates, including the importance of timelines under SOPA and how to generally deal with claims under SOPA.
• General knowledge of the litigation process in Singapore, including knowing which courts address which type(s) of claims.
• General knowledge of the arbitration process in Singapore, including the importance of arbitration clauses
By the end of the course, participants will be able to:
1. Conduct quantitative analysis for various water quality parameters
2. Perform various water quality tests by referencing to the Standard Methods for the Examination of Water and Wastewater
3. Identify the types of water quality tests required for analysis of trade effluent with reference to the discharge regulations in Singapore
Target audience
I. It is generally for companies in Singapore.
II. Contracts Managers with at least 3 years of experience.
III. Those with less experience should be familiar with the basics of contracting in construction projects, the workflow in a Singapore construction project, and the claims process for typical construction projects. Since this is an introductory course, it is not designed for people who have extensive experience in dispute resolution.
Course Outline
Module 1: To understand the general features of the Building and Construction Industry Security of Payment Act 2004 (“SOPA”), including:
1. Differences between a construction contract and a supply contract:
2. What is a construction contract;
3. The different provisions in the SOPA that apply to each category of contract.
4. Applicability of SOPA:
- Contracts that SOPA applies to and contracts that SOPA does not apply to.
- Entitlement to progress payments;
- Payment Claims
- Payment response
- Adjudication application
Module 2: To understand the general features of Litigation, including:
1. What is litigation;
2. Introduction to the different courts in Singapore
3. What kind of cases are heard in each Courts
4. General flow of litigation in the different courts
5. What happens when a judgment is obtained
Module 3: To understand the general features of Arbitration, including:
1. What is arbitration
2. Why choose arbitration
3. What should go into an arbitration clause
4. General flow of an arbitration (in comparison against general flow in litigation)
5. What happens when an Arbitral Award is rendered (is there a right to appeal; how to enforce generally)

Award of Certificate
1. A Certificate of Attainment will be awarded to participants who meet the 75% attendance.
2. This course is qualified for 12 PDUs by PEB.
About the Trainer:
Tan Tian Luh, Director, Chancery Law Corporation
Tian Luh specializes in providing legal services primarily relating to infrastructure, construction and engineering matters. He also undertakes dispute resolution work in respect of corporate and commercial matters. He also advises on all areas of infrastructure, engineering and construction contracts, including drafting contracts, dispute resolution and insolvency matters. He practised previously in the law firm of Helen Yeo & Partners (now Rodyk & Davidson LLP), in the law firm of Thio Su Mien & Partners (now TSMP Law Corporation) and in the highly-rated infrastructure and major projects practice group of Rajah & Tann LLP.
